Terms and Conditions
§ 1 – Provision of information services
The E & S Smart Recruiter Ltd website allows visitors to view information about the entire range of services, employers to send information about vacancies, and job seekers to use the job exchange or other services.
The job exchange allows users to find out about job offers, e.g. B. in the area of employee leasing, direct placement, or in the internal area of Select as well as about offers for starting an apprenticeship and applying online.
For reasons of simplification and better understanding, personal designations are only given in the masculine form below.
The following terms of use apply to the use of our website:
§ 2 – Use of the website and the job exchange
(1) Any natural or legal person is entitled to use the website and job exchange.
(2) Natural persons must be of legal age and legally competent if they wish to apply online via the job exchange. Persons who have not yet reached the age of 18 require the consent of their legal representative.
(3) Use of the portal is free of charge.
(4) The use of certain services requires prior registration as a user.
(5) Select reserves the right to change, supplement, remove or discontinue the data and information provided on the website as well as the website and accounts in whole or in part at any time and without prior notice. Select is not obliged to provide a specific offer.
(6) Select does not guarantee the constant and comprehensive availability of the Select website and job exchange, which can be impaired, for example, by disruptions to the server, the public communication networks, the power supply, or other circumstances beyond Select’s control. In addition, Select reserves the right to temporarily restrict the services through maintenance work and further developments, insofar as these are necessary for proper or improved operation.
(7) Select does not guarantee that the information and content provided on the website and job exchange are complete, correct, and in any case up-to-date. Select makes every effort to keep the information (e.g. job advertisements) up-to-date and error-free and checks this at regular intervals.
§ 3 – Registration as a user of the job exchange / creating an account
(1) If the user applies proactively or for a job offer in the Select job exchange by using the online application service, a profile is automatically created in Select’s applicant management system. Here the applicant has the possibility to change or complete his data at any time.
(2) By applying online and setting up an account, the user gives their consent for their application to be forwarded in a suitable form (by telephone, in writing, digitally) to customers, potential customers, co-partners and Select affiliated companies for the purpose of possible employment allowed to.
(3) Select can send statements to the user by e-mail, fax, or letter to the addresses that the user has given as current contact information in his account.
§ 4 – Entering and protecting the password
(1) In order to gain access to the protected area of an account, corresponding access data in the form of a username and password are mandatory. This data is only assigned to the user personally. The user may not pass these on to third parties. The user must keep the password safe and keep it secret.
(2) To protect yourself against unauthorized use of your own user account, every user should
choose a password that is difficult to guess,
keep your chosen password secret from other people and
do not use your access data (user name and password) on other portals.
Note: Under no circumstances will Select ask for user names and/or passwords by e-mail or on third-party websites.
(3) If the user learns or suspects that the password he has chosen has become known to third parties, he is obliged to change the password immediately.
§ 5 – Obligations of the user
The Select website and job exchange contain, among other things, data and information protected by copyright and/or trademark law, which must be observed:
(1) When providing a photo, document, or other information or items affected by the rights of third parties, the user guarantees that he has the necessary rights, such as the necessary rights of use to use a photo (in particular under the Art Copyright Act and other copyright regulations ).
(2) The user assures that the information he has given about his personal data and his qualifications is correct.
(3) The user guarantees and represents that he is genuinely interested or applying for a job and is not using the website or the job exchange for any other purpose. The user ensures that their use complies with these terms of use. The user may not use the website and job exchange or parts thereof:
to engage in activities that are or may be, directly or indirectly, unlawful, harmful, threatening, harassing, insincere, defamatory, vulgar, obscene, invasive of another’s privacy, hateful or racially, sexually, ethnically, or otherwise offensive;
to carry out activities that infringe or may infringe the rights of third parties;
to possibly transmit content to third parties to which the user has no rights, to not intentionally enter irrelevant, misleading or false information into the system;
to intentionally perform activities that intentionally lead to system disruptions.
Furthermore, the user undertakes to refrain from
impersonate any person or entity;
intentionally providing false information in the online application or recruitment request submitted through the system;
post or transmit any content or information that contains viruses, worms, Trojan horses, or corrupted data;
eavesdrop, intrude, defraud, forgery, disrupt, “hack” or crack passwords.
In the event of an intentional/conscious violation, we reserve the right to take appropriate legal action and to exclude the user from further use of the system.
§ 6 – Liability
If the user violates his obligations under § 4, he is obliged to reimburse Select for expenses incurred and to indemnify and hold Select harmless from claims for damages and reimbursement of expenses by third parties that were caused by the violation. This also applies if the damage is caused by others, insofar as this is attributable to the user. The damage to be compensated includes in particular the reasonable costs of legal defense that Select may incur. All further rights and claims for damages by Select remain unaffected.
§ 7 – Modification of the Terms of Use
When registering or setting up an account on the Select website, the user confirms their agreement to these terms of use. Select reserves the right to change these terms of use at any time without giving reasons, unless this is not reasonable for the applicant. Select will notify the applicant of changes to the terms of use in good time. If the applicant does not object to the validity of the new terms of use within six (6) weeks of notification, the amended terms of use shall be deemed to have been accepted by the applicant. In the notification, Select will inform the applicant of their right to object and the importance of the objection period.
Section 8 – Termination of Use
The user’s right to use it ends when the account is deleted.
